By accessing or using Domain Monster ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. We may update these Terms from time to time; continued use after changes constitutes acceptance.

2. Description of Service

Domain Monster provides an AI-powered platform that helps you design, analyze, and generate website concepts and code. The Service may include market insights, UX recommendations, domain guidance, and code generation. We reserve the right to modify, suspend, or discontinue any part of the Service with or without notice.

3. Eligibility and Account

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate and complete information when signing up or joining programs such as our alpha.

4. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any applicable laws.
  • Infringe on the intellectual property or other rights of Domain Monster or third parties.
  • Attempt to gain unauthorized access to our systems, other accounts, or any data not intended for you.
  • Transmit malware, spam, or any content that is harmful, abusive, or offensive.
  • Resell, sublicense, or commercially exploit the Service in a manner not permitted by us.
  • Use automated means (e.g., scraping, bots) to access the Service without our prior consent.

We may suspend or terminate your access if we believe you have violated these Terms.

5. Intellectual Property and Your Content

Domain Monster and its licensors own all rights in the Service, including design, code, and branding. You retain ownership of content you submit (e.g., website ideas, descriptions). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, process, and display that content as needed to provide and improve the Service. Generated code and outputs may be subject to separate license terms we provide with the output.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT GENERATED CODE OR RECOMMENDATIONS ARE SUITABLE FOR YOUR PARTICULAR USE. YOU USE THE SERVICE AT YOUR OWN RISK.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Domain Monster AND ITS AFFILIATES, OFFICERS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

8. Indemnification

You agree to indemnify and hold harmless Domain Monster and its affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms or any law.

9. Governing Law and Disputes

These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law principles. Any dispute shall be resolved in the courts located in Delaware, and you consent to personal jurisdiction there.

10. General

If any provision of these Terms is held invalid, the remaining provisions remain in effect. Our failure to enforce any right does not waive that right. These Terms constitute the entire agreement between you and Domain Monster regarding the Service.
